Cadre Restructuring in CBDT and CBEC

FINANCE be pleased to state:-


(a) whether all departments/ offices working under Ministry of Finance have implemented Government of India OM No. 36012/45/2005-Estt. (Res.) dated 10.8.2010;

(b) if so, the details thereof and the departments/offices which have not implemented the above OM along with reasons therefor;

(c) whether the above OM was implemented in last cadre restructuring in CBDT and CBEC, if not, the reasons therefor;

(d) the details of the designations of the officers who have not implemented the above OM; and

(e) whether any action has been taken against the officials for not implementing the above OM and if not, the reasons therefor?

(a) and (b):- Yes, Madam. Department of Personnel & Training (DOPT), Government of India OM No. 36012/45/2005-Estt.(Res.) dated 10.08.2010 has been largely followed by Cadre Controlling Authorities of CBEC and CBDT upto 30.09.2016. However, DOPT vide OM No. 36012/11/2016-Estt. (Res.) dated 30.09.2016 issued instructions whereby till such time the SLP(s) on the subject pending in the Hon’ble Supreme Court are decided, while considering promotion, the DOPT OM dated 10.08.2010 is not to be relied upon.

(c) to (e):- The process of cadre restructuring is only change in number of posts in different grades of the departments. Accordingly, DOPT’s OM No. 36012/45/2005- Estt. (Res.) dated 10.08.2010 which deals with reservation in promotions, does not have any impact in cadre restructuring.
