Directions to BIS

Will the Minister of



CONSUMER AFFAIRS, FOOD AND PUBLIC DISTRIBUTION be pleased to state:-


(a) whether the Directions or orders issued by the Government of India to BIS through its controlling Ministry vide order number 4/2/2015-BIS dated 16th November 2015 of the Ministry of Consumer Affairs, Food and Public Distribution have been followed by BIS;
(b) if not, the details of action taken by the Government against BIS;
(c) whether the Government is not empowered to issue directions to BIS under the BIS Act, 1986; and
(d) if so, whether BIS is not acting on the BIS Act, 1986 and the Parliamentary decisions/resolutions by not following the directions of the Government and the details thereof?

(a) to (d) : The Central Government, under Section 24 (2) of the BIS Act, 1986 is empowered to issue directions to BIS. A direction was issued to DG, Bureau of Indian Standards (BIS) on 16th November 2015 to cancel transfers effected by BIS vide its Memorandum dated 13th November, 2015 and DG, BIS was directed to follow the due process laid down in their Placement Policy and effect transfers as per Policy in view of representations received against the transfers. Subsequent reminders were also issued to BIS.

Most of the officers transferred had joined their new place of posting by 16th November, 2015. However, some of the officers filed Writ Petitions which are currently subjudice in the Hon’ble High Court of Delhi
