Government Employees in Elective Offices

PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS be pleased to state:-


(a) whether the Central Government employees while in service can hold an elective office in an organisation being run on commercial lines as per conduct rules governing them and if so, the details of rules in this regard;

(b) whether the Central Government employees can avail tangible or intangible benefits;

(c) if so, the extent to which such benefits can be received without obtaining permission from the competent authority;

(d) the details of the competent authority to permit serving officers of the level of Section Officers and below to contest elections and hold an elective office; and

(e) whether any serving Section Officer of the Ministry of Urban Development is assuming an elective office in Kendriya Bhandar in violation of guidelines/rules and if so, the action proposed to be taken against the erring officer?



ANSWER
Minister of State in the Ministry of Personnel, Public Grievances and Pensions and Minister of State in the Prime Minister’s Office. (DR. JITENDRA SINGH)
(a) to (d): Rule 15(1)(c) of the Central Civil Service (Conduct) Rules, 1964 provides that subject to the provision of sub-rule (2), no Government servant shall, except with the previous sanction of the Government hold an elective office, or canvass for a candidate or candidates for an elective office, in any body, whether incorporated or not.

Rule 15(4) of the Central Civil Service (Conduct) Rules, 1964 provides that no Government servant may accept any fee for any work done by him for any private or public body or any private person without sanction of the prescribed authority.
(e): A Section Officer working as Assistant Director in Directorate of Estates in the Ministry of Urban Development is holding the elective office of Director in the Board of Directors in Kendriya Bhandar since July 2012. He had taken due permission from the Government.
